1- Introduction

These general conditions govern the sale of the products presented on the site:

Any order implies acceptance of these terms of sale. The sales contract is subject to French law.
The shipping packages may take place in France, as well as within the European Union, the DOM / TOM, USA, Canada, Tunisia, Morocco, Algeria, and Norway.
2- The offer
Our offer of products, services and delivery terms, prices in Euro, are valid in France within the European Union and the countries mentioned above, and subject to availability.

3- Prices
Our prices include tax in Euros and do not include additional fixed costs of packaging and shipping of the order processing fee of the order, or bank charges individuals.
The additional fixed costs for packaging and delivery varies according to geographical area of delivery, and is indicated below: Metropolitan France + Corsica Monaco: Free. EU + Switzerland + + DOM TOM Maghreb (Morocco, Algeria, Tunisia): 13 €
POMKIN reserves the right to change prices at any time. Products will be charged on the basis of rates in effect at the time of registration of the order.
4- The order
Any order implies express and irrevocable acceptance of the prices and descriptions of products available for sale.
Users have read and agree irrevocably to these terms of sale before placing the order. The validation of the order implies acceptance of these terms of sale.
5- Acceptation of the offer and confirmation of the order by Pomkin
POMKIN confirm each order by email. The sales contract will be formed when sending the confirmation email.
Pomkin reserves the right to refuse an order if it emanates from a person who has already been an outstanding author, or if the delivery address is a PO Box, a campground or hotel. Due to problems of bad debts from abroad, Pomkin also reserves the right to refuse to deliver an order that would have been paid by Credit Card from a third country. The amount paid will be refunded promptly to the issuer. The invoice attached to the package shall be maintained as it will be used in case of exchange.
6- Payment
The price charged to the customer is the price indicated on the order confirmation sent by POMKIN
Payment can be made by check or postal order, as well as gift Cadhoc for metropolitan France only, check in euros clearable in a bank in France.
The check is made payable to POMKIN and we must be sent with the order, at the following address: POMKIN - service orders, 141 avenue de Verdun - 92130 Issy Les Moulineaux
Cadhoc the gift is accepted as payment for items purchased and can not be used to pay the shipping costs associated with the purchase. Just send it to the address above, with the order. Warning: Pomkin is not allowed to give change if the purchase amount is less than the amount of the check. In case the purchase amount exceeds the amount of the check, just to establish a bank check in addition. Please note, checks Cadhoc have an expiry date: Pomkin reserves the right to refuse any check that would have been beyond that date.
For payment by check, the order is reserved for 5 days of validation. Beyond this period, and in default of payment, the order will be canceled. The Customer will be notified by email.

Bank details are provided in the mail confirming the order.
Payment by bank transfer requires a delay of 24 to 48 h.
- By credit card via the secure payment system of the Banque Populaire
When the transaction is approved, will POMKIN from your package within 2 working days (5 working days for personalized items), in advising you of the Colissimo number, double registered, or UPS tracking distingo.
The order validated by the customer shall be considered effective only when the payment centers concerned have given their approval. In case of refusal, the order will be canceled and the customer notified by email. In addition, the company POMKIN reserves the right to refuse any order from a customer with whom there is a dispute. Following deplored fraud on the internet Pomkin only accepts payment by bank transfer from 400 euros in France, as well as from other countries, whatever the amount of the order. All orders placed from abroad and paid by credit card will be canceled immediately, the issuer will be refunded as soon as possible, and invited to make a payment by transfer.
7- Delivery
The customer must check the condition of the packaging and the Performance of the product, and report any problems or to Pomkin error observed on the order, within 2 working days after receipt of order, it may for send an email to this contact@pomkin.fr
Orders are delivered in France including Corsica and Monaco as well as within the European union, DOM / TOM, USA, Canada, Norway, Tunisia, Algeria and Morocco. Responsibility for POMKIN not be held liable for late delivery, and for any reason whatsoever. Therefore, no claim of any nature whatsoever, can be claimed by the customer to POMKIN
POMKIN uses the services of the Post Office and UPS to ship their packages.
After confirming the order and confirmation of payment by the agency, POMKIN undertakes to submit MAIL or UPS to the goods ordered within 2 working days.
Deliveries are made by Colissimo 48h, 48h followed Distingo, double registered or UPS.
No deliveries to PO boxes, camp or hotel may be made.
In case of absence at the reception, the package is kept 15 days of the filing service. After this time, the parcel will be returned. In this case, a coupon order (excluding shipping and handling) will be published and will expire 2 months from its date of creation.
8- Exchange
If you are not completely satisfied with an item, you can return it within 15 days from the date of receipt in its original packaging, so that you be exchanged or refunded to:

The returned item must be new (not worn or washed) in its original packaging, by Colissimo
Return costs are charged to the customer, the new shipment is the responsibility of Pomkin.
We reserve the right not to refund the return if the product is not intact.
Upon exercise of the right of withdrawal within seven days, Pomkin is required to reimburse the sums paid by the customer at no charge, except for return shipping costs. The return procedure is identical to that of the exchange.
Reimbursement is made via the payment method the customer within a maximum of 30 days.
9- Personnal Data

13- Responsabilities
POMKIN society could be held liable for any inconvenience and damage relating to the use of the Internet such as a break in service, the presence of computer viruses or outside intruders or more generally all cases classified as force majeure by the courts .
